Nova4K respects the intellectual property rights of content creators and rights holders. We comply with the Digital Millennium Copyright Act (DMCA) and the equivalent copyright legislation applicable in Canada. This policy sets out how we handle copyright infringement claims.

1. Our Content Licensing Position

Nova4K operates as a lawful reseller of IPTV subscription services. We do not host, store or originate the content delivered through the Service. All channels and video-on-demand content are sourced from licensed content providers and distributors, and we are committed to ensuring our operations respect applicable copyright law.

2. Reporting Copyright Infringement

If you are a copyright owner or an authorised agent and believe that content accessible through nova4k.ca infringes your copyright, you may submit a written takedown notice to our designated agent.

Your notice must include all of the following

  1. Identification of the copyrighted work — a description of the work you claim has been infringed. A representative list is acceptable where multiple works are covered.
  2. Identification of the infringing material — the specific URL or sufficient information to locate the material.
  3. Your contact information — full name, mailing address, telephone number and email address.
  4. Good faith statement — a statement that you believe in good faith that the use is not authorised by the owner, its agent, or the law.
  5. Accuracy statement — a statement that the information is accurate and, under penalty of perjury, that you are authorised to act for the owner.
  6. Signature — your physical or electronic signature.

We acknowledge valid notices within 5 business days and take appropriate action, which may include disabling access to the material and notifying the relevant content provider.

3. Counter-Notification

If you believe material was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to [email protected].

Your counter-notice must include

  1. Identification of the removed content — description, URL and its location before removal.
  2. Statement under penalty of perjury — that you believe in good faith the material was removed by mistake or misidentification.
  3. Your contact information — full name, address, telephone number and email.
  4. Consent to jurisdiction — that you consent to the jurisdiction of the courts in Canada and will accept service of process from the original complainant.
  5. Signature — physical or electronic.

On receipt of a valid counter-notification we forward it to the original complainant. If no court action is filed within 10 to 14 business days, we may restore the material at our discretion.

4. Repeat Infringer Policy

  • Accounts subject to multiple valid infringement notices are reviewed.
  • Nova4K reserves the right to terminate the subscriptions of users determined to be repeat infringers.
  • Termination for repeat infringement does not entitle the user to a refund. See our refund policy.

5. Misuse of the DMCA Process

Filing a false takedown notice is a serious legal matter. Under the DMCA (17 U.S.C. § 512(f)) and equivalent laws, anyone who knowingly misrepresents that material is infringing may be liable for damages, including costs and legal fees.
